2. Safety & Assumption of Risk

You acknowledge that the App is designed for use within a National Park containing wild and potentially dangerous animals. You voluntarily assume all risks associated with visiting such environments. The App's sighting data is user-generated and may not reflect real-time dangers. You agree to prioritize your safety and the safety of others above any information provided by the App. Tusker Trails is not responsible for any injury, death, or damage to property resulting from your visit to the park.

3. User Conduct & Park Rules

You agree to strictly adhere to all rules and regulations of South African National Parks (SANParks). You explicitly agree NOT to:

Use the App to harass, chase, or disturb wildlife.
Speed or drive recklessly to reach a reported sighting.
Exit your vehicle in prohibited areas.
Post false or misleading sighting reports.

4. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, TUSKER TRAILS AND ITS DEVELOPERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (A) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE APP; (B) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE APP; OR (C) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT.

5. Offline Mode & Data Usage

The 'Offline Mode' feature is a convenience tool designed to acceptively reduce mobile data usage. It does NOT guarantee that all data traffic will be blocked. System-level services, background updates, and other apps may still consume data. You are solely responsible for all mobile data charges, roaming fees, and carrier costs incurred while using the App.

6. Disclaimer of Warranties

THE APP IS PROVIDED ON AN 'AS IS' AND 'AS AVAILABLE' BASIS. WE DISCLAIM ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT MAP DATA OR SIGHTING REPORTS WILL BE ACCURATE.

7. Accuracy of Information

All information provided in the App is based on our best current knowledge and is provided for informational purposes only. We do not guarantee the accuracy, completeness, or reliability of any data, including sighting reports, map geometries, or facility details. The App should serve as a general guide, and you are encouraged to verify critical information with official park authorities.

8. User Content & Data Donation

Your sighting data and logs are stored locally on your device. We do not automatically collect or share your personal monitoring data. However, if you choose to use the 'Donate Data' feature, you agree to voluntarily share your anonymized sighting coordinates and timestamps with Tusker Trails for conservation and research purposes. By performing this voluntary action, you grant us a license to use this specific donated data.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of South Africa, without regard to its conflict of law provisions.
